AmeriColor Corp.’s (“AmeriColor”) Photo Contest (the “Contest”) begins June 5, 2025, at 9:00 AM PST, and ends June 22, 2025, at 12:00 PM PST. By submitting a submission, each contestant agrees to the official rules of the Contest (“Contest Rules”) and states that he or she is 18 years old or older.

Who may enter:

All category prizes are open to photographers who are 18 years old or older at the time of submission. Individuals affiliated with AmeriColor (such as employees, judges, prize providers and licensors) and their immediate families (children, siblings and spouses), and others living in their households, are not eligible for any prize. AmeriColor will determine winners’ eligibility in its sole discretion.

What to enter:

This Contest will have a grand prize winner and a winner in each of these categories:

1. Cakes
2. Cookies
3. Cupcakes
4. Airbrush
5. Macarons
6. Videos

Submissions must be the contestant’s original and previously unpublished work.

Submissions should focus on the finished product or work in progress; hands and arms are acceptable in photos; however, photos with recognizable faces will not be considered.

Submissions should be free of third party copyrighted material. This includes names on T-Shirts and aprons, background artwork or logos of any kind. Submissions that include these elements will not be considered.

Submissions that violate or infringe upon another person’s rights, including but not limited to copyright, will not be considered.

Photos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content, as determined by AmeriColor in its sole discretion, are ineligible for all categories of this Contest.

The contestant should be able to provide upon request all appropriate clearances, permissions and releases for the submission (and in the event that contestant cannot provide all required releases, AmeriColor reserves the right, in AmeriColor’s sole discretion, to disqualify the applicable submission, or seek to secure the releases and clearance for AmeriColor’s benefit, or allow the applicable submission to remain in the Contest).

How to enter:

Please submit photographs / videos and requested information online through our website at americolorcorp.com/contest. You may submit up to 5 photographs per category. Photographs must be submitted in .jpeg, .jpg, or TIFF format. Photos must at least 2,000 pixels wide and no larger than 10 MB. Videos must be less than 10 seconds and less than 20 MB. You must complete a separate form for each photo or video submitted.

Digital photographs should be taken at the highest resolution possible.

AmeriColor may collect a photograph’s metadata upon submission.

You retain your rights to your photograph; however, by entering the Contest, you grant AmeriColor, its affiliates and their respective successors and assigns a royalty-free, fully-paid, transferrable, irrevocable, world-wide, perpetual, non-exclusive license to publicly display, distribute, reproduce and create derivative works of the submissions, in whole or in part, in any media and devices now existing or later developed, for any AmeriColor purpose, including, but not limited to, advertising and promotion of AmeriColor products and its website. AmeriColor will not be required to pay any additional consideration or seek any additional approval in connection with such uses. AmeriColor will not sell submissions to a third party. Contestant further agrees to execute all further documents respecting the submission requested by AmeriColor, including any further license, in order for AmeriColor to use the submission as contemplated by this Contest.

Submission deadline:

The Contest begins on June 5, 2025 at 9:00AM PST. All entries must be received by AmeriColor by June 22, 2025, at 12:00 PM PST. AmeriColor is the official time keeper for the Contest. AmeriColor reserves the right to modify any date(s) or deadline(s) set forth in these Contest Rules or otherwise governing the Contest. Each contestant irrevocably waives any so-called moral rights they may have in the submission. For clarity, AmeriColor has the right (but not obligation) to use the submission.

Judging:

Photo entries will be judged by a panel of one or more judges based on the following judging criteria: creativity, quality, originality, use of AmeriColor products (specifically color) and overall impact. The judging criteria are to be applied in the sole discretion of AmeriColor and the individual judges. By entering the Contest, contestants acknowledge that such evaluations may differ from person to person and agree to be bound by and not challenge the final decisions of AmeriColor and the individual judges. Actual odds of winning depend on the number of eligible submissions received. AmeriColor cannot accurately predict the number of contestants who will participate in the Contest.

AmeriColor will notify winners via the contact information provided at the time of submission by June 26, 2025; AmeriColor may disqualify anyone who fails to respond to the notification within five business days.

Seven prizes will be awarded, as follows:

Grand Prize:

$500. The approximate retail value (“ARV”) of the Grand Prize is $500.

Category Winners:

The winners of each of the six categories will receive a Soft Gel Paste™ Heavenly Seventy Kit. The ARV for the Soft Gel Paste™ Heavenly Seventy Kit is $173.

Winners will be responsible for paying any notary public fees and all income, sales, or excise taxes they may owe on a prize. AmeriColor is not responsible for and will not pay any such taxes.

ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND AMERICOLOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

Conditions of Submission:

Each person who enters the Contest represents and warrants as follows: (a) the submission is the contestant’s own original and previously unpublished work; (b) the submission does not contain any harmful computer code and is not otherwise corrupted; (c) as of the date of the submission, the submission is not the subject of any actual or threatened litigation or claim; (d) the submission does not and will not violate or infringe upon the intellectual property rights, publicity rights, privacy rights, or any other rights of any other person or entity; and (e) the submission does not and will not violate any applicable laws, and is not and will not be defamatory or obscene.

All contestants hold AmeriColor and their respective regents, directors, officers, employees, emeriti, fellows, interns, research associates, and volunteers (the “Indemnified Parties”) harmless from and against all claims of any nature arising in connection with contestant’s participation in the Contest and acceptance or use of a prize. The Indemnified Parties are not liable for any costs, damages, injuries, or other claims incurred as a result of contestant’s participation in the Contest or winner’s acceptance and usage of a prize. The Indemnified Parties are not responsible for incomplete or misdirected entries, technical or network malfunctions or failures, or causes beyond their control. Contestants are solely responsible for their entries. Contestants may not submit materials that introduce any software viruses, worms or other programs designed to damage software, hardware or telecommunications equipment or are off-topic, partisan-political, contain advertising, nudity, personal attacks or expletives, or is otherwise abusive, threatening, unlawful, harassing, discriminatory, libelous, obscene, false, sexually explicit, or that infringes on the rights of any third party.

The Contest is void where prohibited or restricted by law. AmeriColor reserves the right to cancel the Contest or modify these Contest Rules at its discretion. In the event of a dispute regarding the winners, AmeriColor reserves the right to award or not award the prizes in its sole discretion. AmeriColor reserves the right to disqualify any contestant whose submission or conduct appears in any way to: inhibit the enjoyment of others; tamper with the Contest; violate these Contest Rules or other applicable law or regulation; infringe on the rights of third parties; or act in an unsportsmanlike or disruptive manner. Decisions of AmeriColor are final and binding.
